Subject: Amendment to House Rule §7.4 — Use and Conduct in Common-Area Ingress and Egress Pathways.

§1. Background

House Rule §7.4, as adopted at Rev. 12 of the House Rules and last reviewed at Rev. 14 (see §3.2 of House Rules, Rev. 14), governs the use and conduct of unit owners, residents, and invitees within the common-area ingress and egress pathways of the property. Pursuant to §11.1 of the By-Laws, the Board of Managers conducts periodic review of all House Rules pertaining to common-area circulation. The present amendment is issued in accordance with the conclusions of the most recent such review.

§2. Finding

The Board has determined that the rule as previously stipulated is unsuitable for application in the common-area situations enumerated in §4 below.

§3. Determination

It is hereby determined that House Rule §7.4 requires amendment with effect from the date indicated above. The amendment set forth in §4 shall be considered controlling, and any prior text of §7.4 inconsistent therewith shall be considered superseded.

§4. Required Amendment

With effect from the date indicated above, House Rule §7.4 is amended to read as follows. The provisions set forth in this §4 shall apply in each of the common-area situations enumerated below.

§4.1Where the common-area corridor is found to involve a clearance measure of 36 in. or less between any two opposing fixed surfaces, the use of such corridor by unit owners, residents, or invitees shall be conducted in such manner as the Board may from time to time prescribe, and shall not, under any circumstances, result in the obstruction of ingress to or egress from any unit served thereby.

§4.2Where the common-area vestibule is found to involve a clearance measure of 32 in. or less between any two opposing fixed surfaces, the use of such vestibule by unit owners, residents, or invitees shall be conducted in such manner as the Board may from time to time prescribe, and shall not, under any circumstances, result in the obstruction of ingress to or egress from any unit served thereby.

§4.3Where the common-area stairwell is found to involve a clearance measure of 28 in. or less between any two opposing fixed surfaces, the use of such stairwell by unit owners, residents, or invitees shall be conducted in such manner as the Board may from time to time prescribe, and shall not, under any circumstances, result in the obstruction of ingress to or egress from any unit served thereby.
